How to Appeal an NDIS Decision You Disagree With

If you’re unhappy with an NDIS decision — whether it’s about access, your plan, or a review outcome — you have the right to challenge it. Here’s how the appeals process works in Australia.

Step 1: Request an Internal Review

Your first step is to ask the NDIA to reconsider its decision. You must do this within 3 months of receiving the decision. Contact the NDIA on 1800 800 110 and ask for an “internal review.” A different NDIA delegate will look at your case.

Step 2: Apply to the AAT

If you’re still unhappy after the internal review, you can apply to the Administrative Appeals Tribunal (AAT). You must apply within 28 days of receiving the internal review decision. The AAT is independent of the NDIA and can change, set aside, or confirm the original decision.

Getting Help

Disability advocacy organisations can help you through the review process at no cost. Contact Disability Advocacy Network Australia (DANA) to find your local advocacy service.

Tips for a Stronger Appeal

  • Gather supporting reports from your treating health professionals
  • Document how your disability affects your daily life in detail
  • Ask your Support Coordinator or LAC to assist with the paperwork
  • Don’t miss the deadlines — set a reminder as soon as you receive a decision
